US Judge Orders Release of Abrego Garcia from ICE Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without legal authority.
"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.
The case stems from a mistaken removal to El Salvador in March, which the government later acknowledged was an mistake. Following his repatriation to the United States to answer human smuggling charges, he was detained in immigration detention.
In her decision, the court pointed out that the government lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The legal challenge involve disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.
He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing criminal case in Tennessee.
